A MURDER defendant who says his alleged victim sexually assaulted him refused to give police forensic samples to prove the claim, a jury has heard.

David Kilcullen is accused of murdering 59-year-old Gerry Edwards and attempting to murder his partner Chris Bevan, 57, at their apartment in Page Heath Villas, Bickley, on March 3.

The 46-year-old, of The Avenue in Bickley, denies the charges, claiming he stabbed the couple in self-defence after they sexually assaulted him.

This morning one of the investigating police officers told a jury at the Old Bailey that Kilcullen refused to provide evidence to support the allegation following his arrest on March 4.

Detective Constable Aaron Barnes said: “Because of the nature of the allegation Mr Kilcullen had made he was asked if he would like to provide intimate samples, penis and genital swabs, to back up his claim.

“The enquiry went through Mr Kilcullen’s solicitor. It was explained the samples were voluntary.

“The information related back to us by the solicitor was that Mr Kilcullen refused to provide the samples.”

DC Barnes also told the court that throughout a total of nine hours and 51 minutes of police interviews, between March 5 and 7, Kilcullen refused to answer questions about the alleged sexual assault.

Mr Edwards was killed and Mr Bevan attacked between 7.30pm and 8pm on March 3.

Kilcullen claims Gerry Edwards invited him into the flat in Page Heath Villas before 7pm.

He says he fell asleep in an armchair in the living room some time later and awoke to find Mr Edwards and Mr Bevan performing a sex act on him.

This morning the jury heard details of websites visited using Gerry Edwards’ laptop computer on the evening he was killed.

There was evidence of internet activity until 7.36pm, a Met Police computer technician told the jury.

Paul Purnell, defending Kilcullen, pointed out there was a period of 24 minutes, between 7.08pm and 7.32pm, when no internet activity had apparently taken place on Mr Edwards’ laptop.

He said: “It could mean the person had left the computer to do something completely different for 24 minutes.”

Mr Edwards was stabbed four times and died as a result of one of the wounds, which went through his sternum and into his heart. Paramedics pronounced him dead at the scene of the attack.

Mr Bevan spent months in hospital in a critical condition after suffering multiple stab wounds to his scalp, face and chest, and has still not made a full recovery.
